Yaşar University 9th Logistics Days '' ASL LOGISTICS ''

Logistics Days, which is held every year by Yaşar University Logistics Community, is a student organisation where academicians and sector employees convey their experiences to the participants through panels and applied trainings.

Between 31 March - 3 April 2016, we, as ASL Logistics, participated as a sponsor in the Logistics Days held at Altın Yunus Resort & Thermal Hotel, Çeşme with the opening ceremony at Yaşar University Campus. Logistics Coordination Board Comes to Life

As it is known, according to the data of the Ministry of Economy, our transport and logistics sector, which is projected to generate $60 billion in foreign currency revenues in 2023, has the problem of "coordination between different institutions", which is the problem that needs to be solved first and foremost in order to realise its desired potential.

In order to solve this problem, with the "Logistics Coordination Board Circular No. 2016/2" signed by the Prime Minister and published in the Official Gazette dated 28 January 2016 and numbered 29607;

⦁     To determine the roles of public institutions and organisations operating in logistics related works and services,
⦁     Co-ordination on common issues,
⦁     To take decisions on issues that need to be decided jointly,
⦁     "Logistics Coordination Board" was established in order to implement logistics legislative arrangements

  The "Logistics Coordination Board" established within the scope of the Action Plan for Transformation from Transport to Logistics is chaired by the Undersecretary of the Ministry of Transport, Maritime Affairs and Communications, with the participation of the Undersecretaries of the Ministry of Science, Industry and Technology, Ministry of Environment and Urbanisation, Ministry of Foreign Affairs, Ministry of Economy, Ministry of Customs and Trade, Ministry of Interior, Ministry of Development, President of the Union of Chambers and Commodity Exchanges of Turkey and President of the Turkish Exporters Assembly.

  Implementation and follow-up of the decisions taken by the Board will be carried out by the General Directorate of Railway Regulation. The relevant Logistics Coordination Board numbered 2016/2 is attached.

Amendment to Customs Regulation

The amendments made with the "Regulation Amending the Customs Regulation" published in the Official Gazette dated 22.01.2016 and numbered 29601 are as follows.

⦁     In the 86th article titled "Goods that are not subjected to a Customs Approved Process or Use within the Term", "Customs administrations may transfer such goods to a place under the control of customs at the risk and account of the owner of the goods until the status is determined, or the goods in question may be removed to the warehouse by the operator of the temporary storage place on behalf of the owners. During the execution of such transactions, the provisions of liquidation shall continue to be applied to the goods." The provision has been abolished and it has been decided to apply the provisions regarding liquidation directly to the goods that are not subject to any customs regime within the periods determined by the Customs Law.
⦁     Article 96 titled "Transfer of Goods to Another Temporary Storage Place or Warehouse and Transfer of Goods in Temporary Storage Place to Another Person" was amended as "The provisions of the first, second and fifth paragraphs of Article 333 shall also apply to temporary storage operations. With the transfer of the goods, legal liabilities related to the goods, including customs duties and fines, pass to the transferee." paragraph has been added.
⦁     "(4) In simplifications specific to transport types, the special conditions to be sought in addition to the conditions listed in this article and the cases where the conditions specified in this article will not be sought are determined by the Ministry." has been added to Article 224 titled "General Conditions of Simplification Permit and Financial Competence". paragraph has been added.
⦁     To Article 232 titled "Transit Declaration at the Departure Authority" "(3) Transit declarations made by the main responsible through the computerised transit system and not submitted to the departure authority for acceptance within thirty days from the date of the declaration are rejected by the departure authority. In the event that the transit declarations, including the transit declarations in this case, which are not accepted by the departure authority, are rejected by the departure authority, no action shall be taken in accordance with Article 241 of the Law." paragraph has been added and penal action within the scope of Article 241 of the Customs Law has been prevented for the transit declarations that are not accepted.
⦁     With the provisions added to Article 333 titled "Transfer of Goods in Warehouses to Others", in the transfer of solvent and base oil by sale, the conditions for the free circulation of the goods in question by the transferee have been stipulated.
⦁     To the Article 512 titled "Conditions to be Seeking in Temporary Storage Place Operators", the paragraph "(5) The applications of the persons listed in the fourth paragraph of Article 517 for permission to open and operate a temporary storage place and the applications for the transfer of the temporary storage place are rejected until the examination or investigation is concluded in the event that an examination or investigation is found within the scope of misconduct, corruption or smuggling carried out by the customs administration regarding the acts listed in the first paragraph." has been added.
⦁     In the second part of the Customs Regulation titled Customs Warehouses, Article 518 titled "Investment Permit", the paragraph "(5) Warehouse opening and operation investment permit, permit and transfer applications are rejected until the examination or investigation is concluded if an examination or investigation is found within the scope of fraud, corruption or smuggling carried out by the customs administration regarding the acts listed in subparagraph (c) of the first paragraph of Article 519." paragraph has been added.

National and Common Transit Regime: Basic Concepts, Safeguards, Transactions, NCTS and Simplifications

The book "National and Common Transit Regime. Basic Concepts, Guarantees, Transactions, NCTS and Simplifications" prepared by Umut Şedele and Mehmet Uylukçu, experts of the Ministry of Customs and Trade, was published in order to answer the questions regarding the Common Transit System and National Transit transactions within the country, to update the information on the systems for both taxpayers and customs administrations, and to provide detailed information on simplifications in the transit regime, which started to be implemented in our country with our country becoming a party to the Common Transit Agreement as of 2012: Basic Concepts, Guarantees, Transactions, NCTS and Simplifications" book has been published.
